"Relating to the concealed handgun license fee paid by members of state military forces." Thumbs Up
Allows members of the state military forces to obtain a concealed handgun license without taking the state required course, or any other training, at a cost of $25. However, we believe this bill has been substituted, and now only reduces the fee.

"Relating to the confidentiality of certain records maintained by the Department of Public Safety regarding persons licensed to carry a concealed handgun." Thumbs Up
Presently any person may ask the Department of Public Safety whether a named individual has a concealed handgun license, and the Department will disclose the information. This bill removes that provision.

Allows the DPS to establish rules creating special firearms permits for carrying any firearm in places otherwise prohibited, including schools, courtrooms, polling places, bars, etc. These permits can be granted to people whether or not they have a concealed handgun license. Short circuits the license process for favored individuals.

This bill amends Penal Code Section 30.06 so that it can't be used to prohibit concealed carry on government property, and gives the Legislature, subject only to Federal law, sole authority in Texas to regulate the carrying of a handgun.

Prohibits intentionally inhibiting an official proceeding, lawful meeting, procession, or gathering, by displaying a deadly weapon in plain view. If a person participates in, attends, or appears at or in the immediate vicinity of such an event while displaying a deadly weapon in plain view, a peace officer or other individual with authority to control the proceeding or the premises on which the proceeding is conducted may order the actor to leave the immediate vicinity and not return with the deadly weapon. An actor who receives an order under this subsection and refuses to leave or returns with a deadly weapon is presumed to intend to hinder the event. Under this bill, a person who parks next to a parade route with a .22 in the pickup rack could be ordered to leave. This bill may avoid the problem other states with similar legislation have had by unintentionally prohibiting the carrying of rifles by color guards and other ceremonial units.

"Relating to the creation of the offense of using, carrying, or exhibiting a firearm during the commission of certain offenses and to the sentencing of a defendant convicted of the offense." Thumbs Down
This bill creates the offense of carrying, using, or exhibiting a firearm during the commission of any offense except under Chapter 46. There is no limitation as to the type or severity of the offense, including misdemeanors, and no exception for legally carrying. The penalty is five years in prison, after completion of the sentence for the original offense, without possibility of parole.

Currently a replica firearm is not considered a "firearm" for criminal prosecutions if it is "a replica of an antique or curio firearm manufactured before 1899, but only if the replica does not use rim fire or center fire ammunition." This bill further exempts firearms that use rim fire or center fire ammo that is not "readily available in the ordinary channels of commercial trade."

Present law requires anyone shooting on private land in counties with a population of 2 million or more to have on their person written permission to do so. This law reduces the population requirement to 200,000.

Juveniles

Prohibits possession of a rifle or shotgun by a person under the age of 17. It is a defense to prosecution that the person was hunting or participating in other shooting activities, or directly en route, and has a hunting license, or is accompanied by a parent or legal guardian. The hunting license is required even if the person is participating in a shooting event not requiring a hunting license.

Improves PC 46.13, Making a Firearm Accessible to a Child. Allows a "child" to use firearms under the supervision of a person over the age of 16, instead of 18. Allows youth to possess rifles and shotguns acquired with permission of parents are guardians. Strengthens the gun owner's legal defenses.

Shooting ranges are presently excluded from liability for making "unreasonable noise in a public place." This bill moves that exclusion to a more reasonable location in the section.

Selling Firearms

HB 194, by Burnam TEXT ~ ACTIONS Referred to Criminal Jurisprudence 01/25/2001.
"Relating to the prosecution of and the punishment for the offense of unlawful transfer of certain weapons." Thumbs Down
  • It is presently illegal to transfer a handgun to someone if you know they intend to use it illegally. This bill extends that to all firearms.
  • It is presently illegal to intentionally or knowingly transfer a firearm, club, or illegal knife to a person under the age of 18. This bill removes "intentionally or knowingly".
  • "Gun show" is defined as a place or event other than a retail store where:
    1. three or more individuals assemble to display firearms or firearm components to the public; and
    2. a fee is charged for the privilege of displaying the firearms or firearm components or a fee is charged for admission to the area where the firearms or components are displayed.
  • Presently you can transfer a firearm to a person under the age of 18 with parental consent. This bill excludes selling, renting, and leasing from this provision, leaving only the possibility of giving a firearm with parental consent. What about an instructor charging for a firearm course and providing firearms?
  • This bill increases to felony level penalties for transferring firearms to someone who intends to misuse it or a person under the age of 18, and adds even stiffer penalties for doing so at a gun show.

This bill makes it a felony to sell a firearm at a gun show without completing an NICS check, unless the buyer has a concealed handgun license. No provision is made for how a person without an FFL can run the check. A "gun show" is defined as a place or an event, other than a permanent retail store, at which:
  1. three or more individuals assemble to display firearms or firearm components to the public; and

Prohibits selling a firearm at a gun show without conducting an NICS check, except to a concealed handgun licensee or law enforcement officer. Requires anyone selling a firearm at a gun show to keep a record of the sale. A gun show promoter also commits an offense by permitting a sale without a background check. The gun show promoter is required to have an FFL to run the checks, for a maximum fee of $10. The promoter must in writing notify the local law enforcement agency of any gun show no less than 30 days before the event.

Storage

This bill makes it a Class C misdemeanor to store a firearm without locking it in a container or rendering it inoperable by a trigger lock or similar device. A firearm is considered "stored" and must be so secured unless it is being carried by the owner or an authorized user. The bill also prohibits a firearms dealer from transferring a firearm without providing a trigger lock.

Miscellaneous

HB 1456, by Hochberg TEXT ~ ACTIONS Laid on the table subject to call 05/11/2001.
"Relating to paramilitary training organizations; providing criminal penalties." Thumbs Down
Makes it a State Jail Felony to teach or demonstrate to another person, or to meet with two or more persons to train or practice, "the use, application, or making of a firearm, explosive weapon, or technique capable of causing injury or death" with the intention that the training be used to cause civil unrest by a group of more than three people or attack state property or officers. Also makes it a Class C Misdemeanor to belong to an organization that violates this law.
