According to Texas law the first day to prefile bills was Monday, November 12, 2012. The 83^rd Legislature will be in session 140 days, from Tuesday, January 8, 2013 to Monday, May 27. The last day to file regular bills is Friday, March 8.

Governor Perry has until Sunday, June 16 to review bills passed by the State Legislature. He can sign a bill to authorize new law, he can let a bill become law without signing, or he can veto a bill.

I am sure you already have the notice from NRA-ILA announcing the measure proposed for the upcoming legislature session to reduce the required class room hours for issuance of the initial concealed handgun license.
My initial feelings on this as a CHL holder who has taken both the initial training and the refresher is "No way! There is no wasted time in the class room portion!"
How do you feel about this as an instructor and does the board have any official policy on this measure? Our convention will probably be held after this legislation passes or fails. Will there be a communication to the membership about this bill before the convention?

Larry's response:

Practically I would find it difficult to teach all four required subjects in any depth in four hours. However, I philosophically favor Constitutional carry and the elimination of training and licensing requirements. Therefore I've marked this bill with a Thumbs Up. The board has been notified of the change, and may make their own statement.
The TCHA 2013 Conference is scheduled for March 1-3, a couple of months before the fate of the bill will be decided.

I'm not sure this is much of an improvement. It adds BAC .08 to the definition of intoxication BUT in still includes "OR" incapable of exercising normal judgment. I understand many LEOs (including some DPS CHL instructors) will arrest anyone w/a chl that is carrying and smells of alcohol or admits to having one beer.

I think the BAC was always part of the definition. My impression is that this bill consolidates definitions.

I do not see this as needed. The school board president could give all the board members/school superintendent 'written permission.'

Agreed. Actually, unless the school board meeting is held on the premises of a school or is posted with a 30.06 sign, any CHL can carry.

Why are you giving HB383 a thumbs down. Isn't that how a Texas resident's driver license is treated?

First, there's no provision for reciprocity after someone moves to Texas, but before they can get a Texas CHL. Second, I'd really rather have Constitutional carry, so I want less restriction, not more.

HB 47

I do not agree that 4 hours is adequate to cover the topics for the CHL license. Having been an instructor for almost 10 years, the single biggest thing that is taught in the CHL class is not the "rules and regulations" but concepts about situational awareness, safety and avoiding having to ever need to use a weapon in defense. I would agree with 6 to 7 hours but not 4. I do not even teach a reduced "renewal" class, students get the full class regardless. A four hour course is irresponsible and does little to educate the CHL student about the proper mindset and responsibility of carrying a firearm.

Who is responsible for the "thumbs up" and "thumbs down" on the legislative agenda on our website? There is a green thumbs up for reducing training to 4 hours for new applicants and the same for doing renewals online. Is this an association recommendation stance on Flynn's suggested amendments?

In my opinion the current mandates for time spent in the classroom studying theory and laws only scratches the surface for a good, working knowledge base. The class actually catapulted my interested and validated the fact that I better continue studying the laws. Joining organizations such as USCC and Texas Concealed Carry Association certainly helped with topics I needed clarification on. It's a never ending endeavor.
I would not be in favor of lessening the required hours.

I've read over txchia.org's bill listings, the comments and then your comments. Regarding HB-47, I don't believe it's possible for any conscientious, responsible instructor to cover some of these topics in depth in only 4 hours.
Your repeated response, which doesn't address the issue, is "I support Constitutional carry." Well, Larry... water's wet and the sky is blue. We ALL support Constitutional carry. Unfortunately, a license is required. A class is required to qualify for the license. As long as we have to do this, why don't we do it right? There is important information about the application of the statutes, what to expect in the real world, the attitude and mindset of a CHL holder, etc. that doesn't fit into the state's curriculum or the minimized 4 hour timeframe.
I think it's incumbent upon us to either demand Constitutional carry, or provide a worthwhile training class. Turning the CHL training class into a punch-my-card defensive driving class does a disservice to the Texas license holder. Do away with the licensing program entirely, if we can't take this seriously.

You raise some excellent points. I agree that four hours isn't long enough to adequately cover the required topics. I would certainly encourage you to contact your legislators and make your view known. I would hope those who agree with you would also.
In fact, I have written my representative suggesting that the bill be amended to make it clear what we are expected to teach in the abbreviated time alotted.

HB 663

I am concerned.
ATF regs say that CHLs have to be renewed every 5 years. If they extend that for GI's out of TX, then ATF 'may' use that as an excuse to make everyone do a Brady check.
OTOH, their license will be 'expired'. How much good will it do them if they are stopped, carrying on an expired license?
Better solution? Allow them to renew w/o taking a renewal class.

SB 182

Reference your description of SB182, "Concealed carry is prohibited in hospitals or elementary or high schools on college campuses, or sporting events, but only if posted under 30.06."
The use of "or" in the preceding makes it sound like you can now carry at an elementary school or high school or a sporting event if a 30.06 isn't posted.
That is quite confusing. Am I misreading something?
