Texas Legislation

The bill adds one more element to the justification for using force to protect or reacquire personal property from a thief. The language is from other places in the Penal Code dealing with self-defense and the presumption of reasonable belief, both found in §9.31 and 9.32. That's also the language in §46.02(A-1) that I said we need to repeal because it's too narrow since it applies only to Class C traffic violations. Just like the self-defense situations or carrying a handgun in your car without a CHL, littering would mean you cannot use force to defend your property or to reacquire stolen property under §9.41-9.44.

HB554, Another law to protect idiots.
Reference your alert on the TXCHIA web site: "HB 554, by Rep. Drew Springer, passed the Texas House. CHLs who accidentally carry into the secured area of an airport may be given an opportunity to leave the secure area if their gun is discovered."
Taking a gun through airport security is an accident?
It is like I teach in my CHL class, there is no such thing as an accidental discharge, it is either deliberate or negligent. I believe the same is true of bringing a gun into the secure area of an airport.
The excuse that "I forgot about it" falls into the negligent category. Any carrier who "forgets" where his gun is needs to rethink about even carrying a gun. The ones who fall into the deliberate category are simply a morons who thinks they can sneak one through.
In either case it is no "accident" and I do not believe we need a law to let these guys off the hook.
That's my story and I'm sticking to it.

While I agree that CHLs shouldn't make such mistakes, I also believe they shouldn't go to jail for them. Personally, I wish the law went further, and would allow a do-over if a couple of .22 cartridges hide themselves in my carryon.

Before I get into this, I am Life Member of the NRA, an Endowment Member of the TSRA, and CHL holder. I preface with this to demonstrate my commitment to the Second Amendment (not as any kind of boast). You might have guessed there is a however coming here. I cannot abide stupidity and carelessness when it comes to firearms. Any CHL holder who is not aware of where their firearms are and who has access to them at ALL times has crossed over into the aforementioned territory and probably should face some kind of penalty in addition to the abject shame they should already be experiencing. Penal or financial judgments are inappropriate but something along the lines of a required refresher course in firearm safety would fit the crime. That is an even-handed penalty that would be fair despite the depth of one's pockets. I hold Texans to a higher standard than I would, say, a Californian.

Your idea of additional required training is interesting, but I'm not sure how the requirement could legally be imposed without involving an arrest and court appearances. That would almost certainly cost the CHL hundreds of dollers in court costs.
